Terms of Use

1. Agreement to these Terms

These Terms of Use are an agreement between you and DB Precision LLC ("DB Precision," "we," "us"). They cover the DB Precision iOS app, the web app at app.db-precision.com, and the website db-precision.com (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility, minors, and parents

• You must be at least 18 years old, or have the permission of a parent or legal guardian, to use the Services.
• Children under 13 may use the Services only after a parent or guardian confirms consent by email and agrees to oversee the child's use. A parent or guardian's email address is required when a player under 13 signs up or is added.
• A parent or guardian who allows a minor to use the Services agrees to these Terms on the minor's behalf and is responsible for the minor's use of the Services, including purchases.

3. The Services

DB Precision provides baseball training programs, drill videos, strength, speed, and agility workouts, mental performance lessons, Training Builder plans, Smart Recovery guidance, metrics tracking, imports from supported hitting devices, swing video uploads with coach feedback, and messaging. Features vary by plan, organization, and role, and we may add, change, or remove features over time. Features described as coming soon or in testing are not included in any plan until they are released.

4. Accounts and roles

• Provide accurate information and keep it up to date.
• Keep your password confidential and do not share your account. You are responsible for activity under your account.
• Different roles (athlete, parent, coach, organization administrator, and DB Precision staff) see different information and tools. Coaches and administrators must use athlete information only to support that athlete's development within their organization.
• Tell us right away at dbprecisionhitting@gmail.com if you believe your account was accessed without permission.

5. Individual subscriptions and payments

• Plans. Individual plans are monthly subscriptions. The price and included features are shown when you subscribe.
• Apple in-app purchases. If you subscribe in the iOS app, Apple bills you. Your subscription renews automatically each month unless you cancel at least 24 hours before the renewal date in your Apple ID settings. Refunds are handled by Apple under its policies.
• Stripe billing. If you subscribe through our website or a payment link, Stripe charges your payment method automatically each month until you cancel. To cancel, email us before your next billing date. Cancellation takes effect at the end of the current paid month. We do not give partial-month refunds unless required by law.
• Price changes. We will give at least 30 days' notice before a price change applies to your subscription, and you may cancel before it takes effect.
• Failed payments. If a payment fails, we may pause access until it is resolved.
• Complimentary or promotional access may be changed or ended at any time.

6. Access through an organization

If a team, facility, or organization provides your access, its agreement with DB Precision determines your plan, your features, and how long your access lasts. The organization manages its roster and coaches and may remove you. If the organization's access ends, your access through it ends too. You may be able to keep your personal training history by subscribing individually.

7. Training and health disclaimer

Baseball training and strength, speed, and agility work involve physical risk, including the risk of serious injury. You take part voluntarily and at your own risk. Get clearance from a physician before starting a program, stop if you feel pain, dizziness, or unusual discomfort, and train with proper supervision, warm-up, equipment, and space. Parents and guardians are responsible for supervising minors. Our programs are educational and do not replace in-person coaching, a certified strength coach, or medical care. Smart Recovery, hydration, nutrition, and sleep guidance is general information and is not medical advice.

8. No guaranteed results

We do not guarantee performance improvements, metrics, playing time, roster spots, scholarships, recruiting interest, or draft outcomes. Results depend on effort, ability, health, and other factors outside our control.

9. Your content

• You keep ownership of the videos, messages, reflections, and other content you upload ("Your Content").
• You give DB Precision a non-exclusive, royalty-free license to host, store, process, display, and share Your Content with your coaches and organization in order to provide the Services. You also allow us to create de-identified, aggregated data from it to improve the Services. We will not use identifiable videos or images of you in marketing without your separate permission (or a parent's permission, for minors).
• Upload only content you have the right to share. Do not upload content that is unlawful, harassing, threatening, or sexually explicit, or that shows other people without their permission.
• Keep messages respectful and related to training. We may review reported messages and remove content that violates these Terms.

10. AI and analysis tools

Scores, swing analysis, recommendations, and other AI-assisted or automated output are tools to support coaching. They may be inaccurate or incomplete and do not replace the judgment of a qualified coach. Features in testing may change or be withdrawn.

11. Our intellectual property and your restrictions

DB Precision owns the Services and all programs, curricula, drills, drill videos, mental performance lessons, Training Builder and recovery logic, software, designs, and the DB Precision name and logos. We give you a limited, personal, non-transferable, revocable right to use them through the Services while your access is active. You may not:

• copy, download, screen-record, share, sell, or publish our content outside the Services;
• share your account or give others access;
• reverse engineer, scrape, or attempt to extract our source code or data;
• use the Services or our content to build or market a competing product or program;
• rebrand, white-label, or resell the Services without a separate written license; or
• interfere with the Services' security or with other users' data.

12. Third-party services and devices

The Services work with third-party products such as Full Swing and Apple devices, and use providers such as Stripe. Their own terms and privacy policies also apply. Third-party names and logos belong to their owners and do not imply endorsement. We are not responsible for third-party devices, the accuracy of their data, or their outages.

13. Suspension and termination

You may stop using the Services and delete your account at any time. Deleting your account does not cancel an Apple subscription; cancel it in your Apple ID settings. We may suspend or end your access if you violate these Terms, fail to pay, put others at risk, or if your organization's access ends. Sections 7 through 11 and 14 through 18 survive termination.

14. Disclaimers

The Services are provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted or error-free.

15. Limitation of liability

To the extent permitted by law, DB Precision is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some states do not allow these limitations, so they may not fully apply to you.

16. Indemnity

You agree to defend and indemnify DB Precision against third-party claims arising from Your Content, your misuse of the Services, or your violation of these Terms or the law.

17. Disputes and governing law

Connecticut law governs these Terms, without regard to conflict-of-laws rules. Before filing a claim, please contact us at dbprecisionhitting@gmail.com so we can try to resolve it informally within 30 days. Either party may bring an eligible claim in small claims court. All other claims must be brought in the state or federal courts located in Connecticut.

18. Apple App Store terms

If you use the iOS app:

• These Terms are between you and DB Precision, not Apple. DB Precision, not Apple, is responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. Apple has no other warranty obligation for the app.
• Apple is not responsible for addressing claims relating to the app, including product liability claims, legal or regulatory compliance claims, consumer protection claims, or intellectual property claims.
• You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. Changes to these Terms

We may update these Terms. We will post changes on this page with a new "Last updated" date and notify account holders of material changes before they take effect. Continuing to use the Services after that means you accept the updated Terms.
